A woman from Tairi Mbili Village in Mautuma Ward, Lugari Sub-County, has narrated how her efforts to seek compensation from Climax Coaches after she lost one leg following an accident have proven difficult.
Edith Sisia, 30, recounted how she was forced to undergo a traumatizing amputation of her right leg after an ill-fated KCS 562G matatu got involved in a grisly road accident along the Nairobi-Nakuru Highway on March 5, 2020.
“I was involved in a road accident in which my right leg got broken. Doctors advised me that the only way I could survive was by having it cut off. I am now disabled and can only move with the help of crutches,” she said.
Her case to seek compensation from the bus company was taken up by Wachira Waiganjo Co Advocates from Nairobi, who promised to help her get justice by suing the company.
Edith’s mother, Zipporah Shirwanzo, said the law firm has not made any considerable progress since taking up the case.
“They will tell you next week there will be your case hearing. When the date approaches, he (the advocate) calls you and tells you that the court has postponed it. We’re in the darkness; we don’t know if we will ever get justice,” Ms. Shirwanzo said.

The family says it spent most of its resources during the pandemic period to cater for Edith’s medication and seek justice.
The Western Kenya Times tried reaching out to Wachira Waiganjo, a senior advocate at Wachira Waiganjo Co. Advocates. According to the lawyer, the case was continually postponed by the court due to various reasons beyond their control.
Mr. Waiganjo added that he was elected to political office, but his lawyers are following up the story.

“Some of our clients are impatient, but for this case of Edith, the hearing will be on April 5, 2023. Let them be patient and wait. We will sort it out,” he said on the phone.
Edith has a child in Grade Four who depends on her. She is appealing to well-wishers to help her at least buy plastic crutches and start a small business.
“As a family, we don’t have jobs; we do jua kali work, which cannot sustain us well. We would like to get justice so that my daughter can live a better life,” Jamini Wanjala Sereta, his father, said.
